2. OBJECT

https://little-talents.com/ is a web portal owned by LITTLE TALENTS SHOP with CIFB-06914386, through which a series of specialized aesthetic and cosmetic products are put up for sale, subject to the particular conditions included in this document.

At the moment in which the user freely decides to buy on our website, the acceptance of these Conditions of Contract will take place, declaring and recognizing both parties their legal capacity and capacity to act, that the user is of legal age (+18 years), as well as they have previously read and understood their content.

All communications with the end customer by LITTLE TALENTS SHOP will be done electronically.

LITTLE TALENTS SHOP reserves the right to carry out modifications and/or updates to these conditions, of which the client will be previously informed for acceptance or rejection if they are substantial with respect to their rights.

3. OPERATING CONDITIONS OF LITTLE TALENTS SHOP 

3.1 SOLD PRODUCTS

LITTLE TALENTS SHOP offers its users a platform from which they can purchase top quality children's textile products.

3.2. CONTRACTING PROCEDURE

All users who wish to acquire some type of product must follow the following procedure:

1. When the user has accessed the web portal and is clear about which product(s) they want to purchase, they must select the products they wish to purchase, being very important that they review their description, as well as their characteristics, conditions, method and delivery time, and final price of the same before starting the purchase procedure.
2. The customer must start the electronic purchase process by adding the product to the shopping cart, pressing the "Add to cart" button, and then proceeding to press the "Place your order" button.
3. Finally, the customer will only have to enter the desired payment method (PayPal or credit or debit card). LITTLE TALENTS SHOP informs you that you will not have access to your bank details, as these are directly managed by the corresponding banking entities in our payment gateway.
4. Then the client must review and confirm the postal address indicated and choose the standard delivery, whose delivery time will be 24/72 hours.
5. Finally, the customer must enter the details of the payment method they have chosen, indicate whether the billing address is the same or, if not, enter the billing address and finally indicate whether they wish to remember the information filled in for subsequent purchases.
6. The client will automatically receive from LITTLE TALENTS SHOP a confirmation e-mail in which the entire purchase made and its characteristics will be described.

 

In the event that the final customer selects in the same purchase process products that are part of specific offers and/or promotions, beside products from the permanent catalogue published by the sellers, the system will automatically offer the option of delivery or collection of the product that is more economical, and in any case that produces savings for the end customer.

The electronic sales contract will be understood to be signed between the user and LITTLE TALENTS SHOP and perfected at the moment in which the product actually purchased is delivered to the user at the address that has been selected.

3.3 SHIPPING POLICY

The products purchased by the client will be delivered to the users at the address that they indicate on the form for the purpose of the contracting procedure.

3.3.1 STANDARD SHIPPING

The shipping method available to LITTLE TALENTS SHOP is standard shipping.

The shipping costs will be managed by the company GENERAL LOGISTICS SYSTEMS SPAIN, SA (GLS SPAIN) and will be free if the purchase exceeds 90,00 € (Europe), otherwise, the shipping costs will be as follows:

1. 4,90 €: Mainland Spain.
2. 10,00 €: EU countries.
3. 15,00 €: Countries outside the EU.
4. For shipments to the rest of the world, consult through the email address: hello@little-talents.com

 

Orders will be processed (from Barcelona) the next business day after the purchase, from Monday to Friday, except holidays.

3.4 OFFERS AND PROMOTIONS

LITTLE TALENTS SHOP will have the power to launch and send you offers, additional discounts and/or specific promotions, with a certain duration period, being in any case subject to the requirements or temporary or availability limitations.

4. DISTANCE CONTRACTING

According to the provisions of the Law on Information Society Services and Electronic Commerce, contracts entered into electronically will produce all the effects provided for by the legal system, when the consent and other requirements necessary for its validity are present.

The electronic support that appears in these contracting conditions concluded electronically will be admissible as documentary evidence in case of dispute between the parties.

In the same way, and in accordance with the provisions of the aforementioned regulations, all the information related to the same is made available to users, prior to the start of the contracting procedure, which will only be applicable in the event that the user decides proceed with the contracting through LITTLE TALENTS SHOP.

Likewise, it will be understood that the monitoring of all the phases of the registration process and, where appropriate, the payment of the corresponding economic amount, necessarily imply the provision of the consent required for the contracting.

4.1 PREVIOUS INFORMATION

Access to the contracting process is completely free, without any additional associated cost, apart from those of the user having an Internet connection.

LITTLE TALENTS SHOP will introduce adequate and sufficient technical means to identify and correct technical errors in the management of information as soon as it is its responsibility.

All the products marketed are perfectly described in the product sheet made available to customers, not understanding those issues that have not been expressly indicated therein to be included.

The language in which the contracting procedure will be processed and in which this contract is formalized will be, unless otherwise indicated, Spanish and English.

4.2 LIMITATIONS ASSOCIATED WITH SALES

LITTLE TALENTS SHOP campaigns have a certain duration, which can be reduced by the sale of all available stock, which will be indicated eventually.

The customer can make the purchase of any of the products marketed by LITTLE TALENTS SHOP at any time, if, in the case of products with some type of limitation, the promotion in question has not ended or the stock has been consumed and thus has been informed of it through the platform. In the event that the purchase period does not end before the end of the campaign, LITTLE TALENTS SHOP reserves the right to cancel said purchase, for having been made outside the validity period of the campaign.

If the sale of the product is subject to some type of limitation, whether temporary or due to availability of product units, said limitation will be duly specified in the description of the specific product in such a way that the user is fully aware of it before making the purchase buys.

4.3 ECONOMIC CONDITIONS

The price of the products marketed by LITTLE TALENTS SHOP is specified in each of them, using the official currency Euro (€).

4.4.1 PRICES

The price of the LITTLE TALENTS SHOP products are included together with the rest of the description of the products, being public access, without the need to be registered as a user.

All prices shown are final prices, expressly including the Value Added Tax (VAT) applicable in Spain at the time of purchase.

In the case of offers or promotions, the prices indicated for each product are the prices applicable to the marketing of said product in each specific promotion, taking each promotion individually as a reference.

4.4.2 PAYMENT AND BILLING

After placing an order by the user and making the corresponding payment through any of the payment methods made available by LITTLE TALENTS SHOP, the platform will send the end customer an email in which all the information related to the products will be collected. purchased, its price, applicable taxes, as well as the total price of the purchase and the place of delivery of the same. 

The payment of economic amounts through the Internet will be made through the platform provided by an external financial entity, which in any case will be hosted on a website under a secure SSL protocol.

The purchase will only be effective when LITTLE TALENTS SHOP receives confirmation of payment by the bank that owns the secure payment gateway. If the transaction is for any reason denied by said entity, or the full amount corresponding to the amount of the order is not provided (including surcharges for management fees and bank transfer fees), it will be suspended informing the end customer that the transaction is not has been finalized.

By accepting these conditions, the user expressly consents to receive the invoice electronically. Once the user requests the invoice, LITTLE TALENTS SHOP will send the electronic invoice within 15 days to the email address provided through the user account. If the client wishes to receive the invoice on paper, they can contact LITTLE TALENTS SHOP indicating the postal address to which the invoice will be sent.

4.5 LITTLE TALENTS SHOP PROMOTIONAL CODES

LITTLE TALENTS SHOP reserves the right to deliver gift vouchers and/or promotional or discount codes to its users. The use of these may be subject to minimum purchase amounts or other restrictions. The particular conditions on the use and execution of our promotional codes will be stipulated in the delivery of the same.

5 GUARANTEES AND RIGHT OF WITHDRAWAL (RETURN POLICY)

5.1 GUARANTEES

LITTLE TALENTS SHOP, guarantees that all the products offered are original brand products, with a manufacturer's guarantee and without any defect, with their legally recognized guarantee periods. The other products marketed through LITTLE TALENTS SHOP have the legally established minimum warranty period and will be that of the very nature of the product.

In the unlikely event that a marketed product shows any damage, please contact LITTLE TALENTS SHOP immediately via email hello@little-talents.com, to indicate the procedure to return the product. Now in which the defects of the same are verified, the same will be repaired or replaced, or a reduction in the price will be made or all the economic amounts paid will be returned, as appropriate in each case, not assuming in no case, an additional cost for the client.

In order to assert the guarantee of the products purchased, the consumer can contact both the seller and the manufacturer from the delivery of the product and always in accordance with the conditions and limitations set forth in the applicable regulations.

In the event that the defect or lack of conformity manifests itself after 6 months from the delivery of the product after purchase, the customer must demonstrate to the manufacturer or seller that the failure, defect or lack of conformity already existed when the product was delivered originally existed.

When a product does not conform, the customer may choose between its replacement or repair, without the customer being charged the expenses that these events entail.

In case of lack of conformity with the product received, the consumer has the obligation to inform the seller within two months of becoming aware of it.

To claim and start processing the incident, the customer must write an email to hello@little-talents.com, indicating the facts and the necessary instructions will be provided to meet your request.

5.2 RIGHT OF WITHDRAWAL

In accordance with the provisions of the General Act for the Defence of Consumers and Users and other complementary laws, users are informed of the following aspects:

All users can exercise their right of withdrawal within a maximum period of 14 calendar days from the time the product was received, and must be exercised directly against LITTLE TALENTS SHOP and under no circumstances against the seller.

The user who wishes to exercise his right of withdrawal regarding the purchase made, must follow the following steps in any case:

1. Communicate to LITTLE TALENTS SHOP your desire to exercise your right of withdrawal through any of the customer service channels or, if you prefer, by sending any other unequivocal statement that you wish to exercise your right of withdrawal. Once received, LITTLE TALENTS SHOP will inform the user how to return the product, even before starting the contracting process described in these conditions.
2. The user must assume the direct costs of the return, informed in any case by LITTLE TALENTS SHOP during the process. Likewise, the user will assume any possible damage or deterioration of the product during transport and the derived responsibilities.
3. In the case of products that are not suitable to be returned for reasons of health protection or hygiene, the user must deliver the product properly packaged, without unsealing and without clear signs that it has been opened, used and/or manipulated. Once the product is received, if any type of manipulation, damage or sign is detected that suggests that the product in question has been manipulated, opened, modified, altered or there is a risk of it, the product in question will be immediately returned to the end customer by postal delivery cash on delivery, the user assuming the shipping costs. On the other hand, the return of all those products that are intact, and do not present any type of manipulation of the protective film of the box or wrapping, will be accepted.
4. Upon receipt of the request to exercise the right of withdrawal, the system will send an email confirming that it has received the request. Subsequently, it will proceed to refund the economic amount paid (including, where appropriate, the delivery costs and less the direct costs of the return in case the transport offered by LITTLE TALENTS SHOP has been used) within a maximum period of 14 calendar days from the time of receipt of the request for the right and receipt of the purchased product. In any case, the payment of the economic amounts will be made through the means used by the user to make the initial payment, unless the user states a different one and in which case he may incur additional costs.

It will not be possible to exercise the right of withdrawal in those cases in which products made according to the consumer's specifications or clearly personalized are purchased, or that, due to their nature, cannot be returned or may deteriorate or expire quickly.

On the other hand, it will not be possible to exercise the right of withdrawal when the products that are already unsealed are not suitable to be returned for reasons of health protection or hygiene.

LITTLE TALENTS SHOP will reimburse the user for the price of the product, as well as the initial shipping costs. The user always bears the return costs.

In the event that the user requests the exercise of their right of withdrawal, the end customer will be reimbursed all the economic amounts initially paid, including, where appropriate, the delivery costs, without undue delay and, in any case, before the 14 calendar days have elapsed from the date on which the right of withdrawal was requested and provided that the product or proof of its return has been received.

In the event that the user had been offered various delivery methods and he had expressly selected a delivery method other than the least expensive method of ordinary delivery, LITTLE TALENTS SHOP will have the right not to return the additional costs derived from said method. of delivery.

5.3 RESPONSIBILITIES OF LITTLE TALENTS SHOP

LITTLE TALENTS SHOP undertakes that the contents, data or information regarding the products or services offered on its website are reliable, truthful and exact, and is responsible for the prices and characteristics advertised.

The products offered have the legally recognized guarantee periods.

The catalogues provided by each of the sellers attached to the platform are their responsibility and must comply with current legislation at all times.

5.4 CUSTOMER SERVICE

LITTLE TALENTS SHOP makes available to end customers and affiliated sellers a customer service in Spanish and English, via email hello@little-talents.com, in which due attention will be given to all queries, complaints and questions raised in relation to the purchase of products through the LITTLE TALENTS SHOP system.

In order to guarantee direct attention from the customer service department, in the event that a user has a claim, they will be provided with an identification number and proof of the claim submitted will be sent to their email address, with a response to claims received as soon as possible from the filing of the claim.

6. UNAUTHORIZED USES

LITTLE TALENTS SHOP reserves the right to cancel the account of the registered user or client, being able to proceed to the resolution of this contract. In particular, the cancellation may be made as a client and/or as a user in case of detecting the breach of any of the contractual obligations contracted in this act, as well as in case of observing a use of the website and/or the account contrary to the general terms of use, the privacy policy of the website and the good faith accepted uses in the sector.

7. INTELLECTUAL AND INDUSTRIAL PROPERTY

LITTLE TALENTS SHOP guarantees through this contract that it is the legitimate owner of the platform, as well as the coupon validation tools delivered to the network of collaborating establishments.

The client expressly acknowledges that LITTLE TALENTS SHOP holds all right, title and interest in the platform and the tools associated with it, as well as in all its modules, modifications and updates and in any element and/or functionality that was developed on it.

For these purposes, the acknowledgment of the ownership of LITTLE TALENTS SHOP of all copyright, intellectual property, and/or industrial rights is included without limitation, being able to exploit the platform, without any restriction of a temporary, territorial nature, relative to media of diffusion or modalities of exploitation and without more limitations than those established in the laws, all the contents published in it.

The characteristics, structure, codes, working methods, information systems and their exchange, development tools, know-how, methodologies, processes, technologies or algorithms that constitute and/or may constitute the platform, are the exclusive property of LITTLE TALENTS SHOP, being duly protected by national and international intellectual and/or industrial property laws, and may not be subject to further modification, copying, alteration, reproduction, adaptation or translation by the client without the prior express consent of LITTLE TALENTS. SHOP.

The provision of the platform or the mere access by the client does not imply, in any case, the transfer of its ownership, nor the granting of a right of use in favour of the user other than that expressed in this clause.

In order for the client to be able to use the platform, which is the exclusive property of LITTLE TALENTS SHOP, it assigns by virtue of this contract a license of use in favour of the client of a nature: non-exclusive, with a temporary scope limited to the duration of this contract, of unlimited spatial scope to the extent that it can be accessed from any computer with the Internet, non-transferable, revocable and non-sublicenciable.

Any type of reproduction, imitation, transmission, translation, modification, elaboration of derivative work and/or public communication is not permitted, regardless of the means used for it; otherwise the client or third party offender assumes all direct or derived responsibilities that they could occur.

8. RESPONSIBILITIES

LITTLE TALENTS SHOP and the user undertake to comply with their legal and contractual obligations generated under this contract.

In the event that one party does not fulfil any of its obligations, or hinders the fulfilment by the other party of theirs, the right of the other party to claim compensation for the damages caused will be generated.

LITTLE TALENTS SHOP will not be responsible in case of unavailability of the product or impossibility of delivery due to force majeure, theft or loss of coupons or error in the order or data provided by the user. However, in such cases, LITTLE TALENTS SHOP will immediately contact the client in order to find the best solution.

The parties will be liable for the infractions they may have incurred personally, leaving the opposing party harmless against any error, fault or negligence not attributable to it, and any damage arising from said infractions or errors attributable to the other contracting party.

LITTLE TALENTS SHOP will make every effort to keep its services available through the website, which constitutes an obligation that, however, will not apply to any lack of availability or performance caused by temporary inactivity of the website due to updates or technical maintenance or causes beyond the control of LITTLE TALENTS SHOP, with no compensation from LITTLE TALENTS SHOP to the client for lost profits, damages or losses in this regard.

In case of suspension or closure of the website for reasons beyond the control of the parties, the client will be promptly informed of the transfer of the service to a new domain, only modifying the stipulations of this contract in relation to the domain in which the platform remains active.

9. APPLICABLE REGULATION

These general contracting conditions are expressly subject to the provisions of Act 34/2002 of July 11, on Services of the Information Society and Electronic Commerce, Royal Legislative Decree 1/2007, of November 16, which approved the Act of Consumers and Users, Royal Decree 1906/1999, of December 17, 1999, which regulates Telephone or Electronic Contracting with general conditions, Act 7/1998, of April 13, on General Conditions of Contracting, Act 7/1996, of January 15, on the Regulation of Retail Trade, Regulation (EU) 2016/679, General Data Protection and other legislation of a general nature or of subsidiary application in accordance with the basic principles of organization of the legal system Spanish legal.

Notwithstanding the foregoing and the application by default of Spanish national regulations, while LITTLE TALENTS SHOP is not a provider of services of the information society that directs its services towards a State other than Spain, in accordance with the provided in the Directive and only in those cases in which it is mandatory, LITTLE TALENTS SHOP will apply the particular conditions that may be applicable in the country of residence of the final consumer.

10. COMPETENT COURTS

Spanish law governs these Contract Conditions. The parties submit, at their choice, for the resolution of conflicts and waiving any other jurisdiction, to the Courts and Tribunals of Barcelona.
